Omni Case Management Services (“Omni-CM,” “Our,” or “We”) respects Your right to privacy. This Privacy Policy explains how Omni-CM, a Minnesota Limited Liability Corporation with company offices in Minneapolis, MN, and any of its subsidiaries and affiliates, complies with federal and state laws as it collects, uses, discloses, or otherwise processes personal information about or provided by users of our services (“Participant(s)”) or visitors to our website (collectively referred to herein as “You”, “Your”) including:

  • visitors to our website or landing pages (“Omni-CM Website”);
  • users of the Omni-CM Services;
  • persons acting on behalf of these individuals;
  • Your healthcare providers, employers, and/or insurers; and
  • any other persons, partners, customers, or organizations that engage with Omni-CM.

Omni Case Management is committed to protecting Your privacy and the privacy of Your health information. If You use the Omni-CM Services, Your care and treatment is recorded in a case management record. To meet Your case management needs, we will share Your case management record with the providers involved in Your care. We share Your information only to the extent necessary to collect payment for the services we provide, to conduct our business operations, and to comply with the laws that apply. We will not use or disclose Your health information for any other purpose without Your permission.

Before accessing, visiting, or using Omni-CM’s Website, the Omni-CM Services, and/or providing Omni-CM with any personal information, including personal health information as described in this Privacy Policy, You acknowledge that You have read, understand, and agreed to all of the terms and conditions set forth in this Privacy Policy. Omni-CM reserves the right, at any time and in its sole discretion, to modify or change this Privacy Policy.

HOW OMNI-CM COLLECTS PERSONAL INFORMATION ABOUT YOU

For the reasons set forth herein, Omni-CM collects personal information about You (including identifiable and non-identifiable data) through Your access to and/or use of Omni-CM’s Website and/or the Omni-CM Services including through Your communication with Omni-CM Personnel, from Your physician and/or other health care providers, and from Your employer and insurer.

Omni-CM may use technology that makes a record of Your activity on the Omni-CM Website. Omni-CM may also use “cookies”, “pixels”, or web beacons and/or other types of files or software code to collect IP address, device type, device identifiers, browser type, browser language, web pages accessed, URLs, platform type, clicks, domain names, landing pages, the amount of time spent on particular pages, the date and time of Your activity on the Omni-CM Website, and other similar information. You may adjust the settings on Your web browser to limit the type of cookies allowed.

THE TYPE OF INFORMATION ABOUT YOU THAT OMNI-CM COLLECTS

  1. Personal Health Information

Omni-CM may create, collect, receive, maintain, store, transmit, disclose, and/or use personal health information about You through Your use of the Omni-CM Services. Your personal health information may include, without limitation, the following: (i) the identity of physicians and/or other health care providers that have examined and/or treated You, (ii) diagnostic and symptom information about You including, without limitation, any diagnosed conditions, (iii) prescriptions, treatment plans and treatment protocols applicable to Your conditions, (iv) medical imaging and photographs providing information about Your conditions, (v) laboratory and other test results relating to Your conditions, (vi) information about Your use of the Omni-CM Services, (vii) information You input into the Omni-CM Website, (viii) information You disclose to Omni-CM Personnel, (ix) information You disclose to Your physician and/or other health care provider about Your symptoms, diagnoses and treatment progress, (x) information obtained from other third parties including Your insurance providers and employers.

  1. Personal Information

The personal information, including personal health information, about You that Omni-CM collects and stores may include, without limitation, Your full name, email addresses, physical addresses, age, date of birth, phone numbers, employer(s), social security number, gender, geographic information, health insurance plan information (including insurance identification numbers), device identifiers (MAC and IP addresses), and other information that You provide when You are communicating with Omni-CM personnel, using the Omni-CM Website or Omni-CM Services, and/or that You provide to Your physicians and/or health care providers which they then communicate to Omni-CM.

WHERE OMNI-CM STORES INFORMATION ABOUT YOU

Omni-Cm stores information gathered through Your use of the Omni-CM website or use of the Omni-CM Services on All or some portion of Your personal information, including personal health information, and other information about You as described above, may be stored on (i) Your computer or mobile device that You use to access the Omni-CM Website, and (iii) Omni-CM’s information network including, without limitation, cloud storage providers.

HOW OMNI-CM USES INFORMATION ABOUT YOU

Omni-CM uses Your personal health information, and other information collected about You, for a variety of purposes as permitted or required by, applicable law, including but not limited to, the following:

  • To communicate with Your healthcare providers, employer, and insurer(s) to facilitate the provision of services to You;
  • To facilitate the evaluation and formulation of a rehabilitation plan to assist You;
  • To assist in the provision of job search and placement activities as part of the Omni-CM Services;
  • To provide You with information and to answer any questions that You may have about the Omni-CM Services;
  • To provide case management services to You as agreed upon;
  • To provide You with information, as needed, for You to benefit from the Omni-CM Services;
  • To assist You in obtaining reimbursement from insurers for Your claim related expenses, although Omni-CM has no control over insurers’ coverage decisions;
  • To obtain information from You about Your medical conditions and medical treatments;
  • To manage the operation of the Omni-CM Services;
  • To make improvements to the Omni-CM Services;
  • For internal quality assessment, business improvement, and internal development;
  • For any other purpose not prohibited by applicable law.

Text Messages and Similar Notifications

When You provide Omni-CM with Your telephone number, Omni-CM may send text message notifications directly to Your mobile device as part of the Omni-CM Services. Text messages require the use of public networks and/or third-party service providers, and standard text messaging is not a secure mode of communication. If You do not want to be contacted by Omni-CM personnel through text messaging, You may request that Omni-CM not contact You via text messaging or reply “STOP” to any text message sent by Omni-CM and Omni-CM will cease all communication with You through text messaging.  Omni-CM will never use text messaging to send marketing messages.

HOW OMNI-CM DISCLOSES INFORMATION ABOUT YOU

  1. Permitted Sharing of Your Personal Information

Omni-CM may disclose Your personal health information and/or other personal information about You as permitted by and/or in accordance with applicable law including, without limitation:

  • to provide You with workers compensation case management services;
  • with Your physician and/or other health care provider to facilitate Your medical treatment and services;
  • to persons and/or entities authorized by You in writing to receive such information;
  • with Your employer with Your authorization;
  • with Your insurer;
  • to bill and receive payment for the treatment and services You receive; and
  • for internal business functions necessary to operate Omni-CM and to ensure that our participants receive quality services.

Omni-CM will not sell or rent Your personal information to any other company or organization.

  1. Sharing Personal Information with Third Parties

To facilitate the provision of services, Omni-CM may share some personal information, including personal health information, with third parties that we engage to perform services or functions on our behalf. When Omni-CM shares personal information with our third-party partners, we do not authorize them to use, share, or disclose Your personal information with others for purposes other than the provisions of services that they have been retained to provide.

  1. De-Identified and Aggregate Data

Once personal information, including personal health information, has been fully de-identified so that it cannot be tied to any specific individual, it is no longer considered personal information or personal health information. Omni-CM de-identifies personal information and compiles this data to create anonymous aggregate statistics.  This aggregate data is used to help Omni-CM continually improve the services. Omni-CM may disclose de-identified treatment information to third parties to the extent not prohibited by applicable law.

  1. Disclosure Required Under Law

Omni-CM may disclose or report information about You as permitted by, required by, and/or in accordance with applicable law:

  • if we have a good faith belief that we are required to disclose the information in response to legal process (for example, a court order, search warrant or subpoena);
  • if we believe that the Omni-CM Website is being used to commit a crime;
  • if we have a good faith belief that there is an emergency that poses a threat to the health or safety of a person or the general public; and
  • in order to protect the rights or property of Omni-CM.

If Omni-CM sells all or a portion of its business, we may transfer all of Your information that we collected including, without limitation, personal health information, to the successor organization as permitted by and in accordance with applicable law.

HOW OMNI-CM PROTECTS YOUR PERSONAL INFORMATION INCLUDING PERSONAL HEALTH INFORMATION

Omni-CM protects the personal information it has collected about You, including personal health information, by using industry standard security precautions against loss, unauthorized access, destruction, misuse, modification, or disclosure.

Even though Omni-CM takes precautions to maintain the confidentiality of Your information, it is important to keep in mind that any information that You provide to Omni-CM through the Website, the Omni-CM Services, e-mail, text messaging (SMS and/or MMS), voicemail, or by other means may not be secure and may be susceptible to third party interception. As a result, You understand and agree that You transmit information to us at Your own risk, and that we are not liable for any data breaches. Please refer to the disclaimer and limitation of liability provisions in the Omni-CM Terms and Conditions.

To help prevent unauthorized access, maintain data accuracy, and to protect against the inappropriate use of the information we collect, store, and transmit, Omni-CM has implemented a range of technical and administrative safeguards. We apply reasonable and appropriate measures to safeguard the confidentiality, integrity, and availability of all personal information, including personal health information, which Omni-CM uses, maintains, stores and/or discloses as part of the services it provides. However, as indicated above, no website or internet transmission is completely secure. Unauthorized access, hacking, data loss, data breach, or other types of data misuse may occur. Accordingly, any transmission of Your personal information, insurance information, and/or any other information about You provided by You, Your healthcare providers, insurer, or employer to Omni-CM is at Your own risk. You acknowledge and agree that Omni-CM will not be liable for any harm or damage to You or anyone else for any unauthorized access, hacking, data loss, data breach, or other type of data misuse.

RIGHT OF ACCESS TO PERSONAL HEALTH INFORMATION ABOUT YOU THAT OMNI-CM MAINTAINS

You may choose to decline to share certain personal information with Omni-CM.  In addition, You may choose to revoke Your consent for Omni-CM to use Your personal information for purposes other than those pertaining to Your care and treatment, payment for services and other healthcare operations.

NOTICE OF MATERIAL MODIFICATIONS OR CHANGES TO OUR PRIVACY POLICY

Omni-CM may make modifications or changes to this Privacy Policy from time to time. Omni-CM may, but is not required to, send You notice of such modifications or changes by email, text message, and/or other written communication. You will be notified that modifications and changes to the Privacy Policy have been to this Privacy Policy by a change in the Date of Last Revision at the top of the first page. You should always check the Date of Last Revision at the top of this Privacy Policy prior to using the Omni-CM Website and/or the Omni-CM Services to see if the Date of Last Revision has been updated. By continuing to use the Omni-CM Website and/or the Omni-CM Services after the Date of Last Revision, You agree on behalf of Yourself, Your minor child and/or any person or entity for whom You are acting to the terms of the revised Privacy Policy with all modifications and/or changes, and that such revised Privacy Policy shall supersede and replace any prior version applicable to Your prior use.

OUR POLICY TOWARD CHILDREN

The Omni-CM Website and the Omni-CM Services are not intended for use by children under the age of thirteen (13). Omni-CM does not intend to or knowingly collect any personal information regarding children under the age of thirteen (13). Children under the age of thirteen (13) should not use the Omni-CM Website at any time. If we learn that we have collected personal information directly from a child under the age of thirteen (13), we will delete such information. Notwithstanding the foregoing, the Omni-CM Website and the Omni-CM Services may be used for the benefit of a minor child by the child’s parent(s) or legal guardian.

PRIVACY POLICIES OF LINKED SITES

Omni-CM is not responsible for the privacy practices, security, or the content of any non-Omni-CM websites that are linked to the Omni-CM Website.  If You have any questions about how these other websites use Your information, You should review the non-Omni-CM websites’ policies and contact them directly. Omni-CM is not responsible for the actions of third-party advertisers, service providers and/or any other third parties.

YOUR WRITTEN AUTHORIZATION RIGHTS

Certain uses or disclosures of Your, Your minor child, and/or any other person on whose behalf You are acting’s personal information, including personal health information, may require Your specific written authorization. You agree that Your authorization may be effectuated by use of Your electronic signature, including Your electronic expression of Your agreement on the Omni-CM Website to the fullest extent not prohibited by applicable law. If You change Your mind after authorizing such a use or disclosure, You may submit a written revocation of the authorization to the Privacy Officer as indicated herein. However, Your decision to revoke authorization will not affect or undo any use or disclosure of information that occurred before You notified Omni-CM of Your decision to revoke Your authorization.

COMPLAINTS OR QUESTIONS ABOUT PRIVACY POLICY

If You have any questions, comments, or complaints regarding Your privacy rights or concern that Your privacy rights may have been violated, contact Omni-CM’s Privacy Officer, in writing, at the contact information provided above. You will not be penalized or otherwise retaliated against for any questions, comments or for filing a complaint.

THIS PRIVACY POLICY IS INCORPORATED INTO AND SUBJECT TO THE OMNI-CM TERMS AND CONDITIONS. BY ACCESSING, VISITING, AND/OR USING THE OMNI-CM WEBSITE OR THE OMNI-CM SERVICES, YOU REPRESENT AND WARRANT THAT YOU HAVE READ, UNDERSTOOD, ACCEPTED, AND AGREED TO ALL OF THE TERMS AND CONDITIONS SET FORTH IN THIS PRIVACY POLICY AND THE TERMS AND CONDITIONS, ON BEHALF OF YOURSELF, YOUR MINOR CHILD (IF APPLICABLE), AND/OR ANY PERSON OR ENTITY FOR WHOM YOU ARE ACTING.
